Five infant deaths have prompted government officials to file a lawsuit against the makers of Nap Nappy, a portable baby recliner that has been sold on the market since 2009.
An administrative complaint was filed Wednesday by The Consumer Product Safety Commission, asserting that the newest design of the Nap Nanny and two earlier models “pose a substantial risk of injury and death to infants”.
The CPSC is hoping for a court order that would require the makers of the Nap Nanny to offer full refunds to consumers and post a public notice about what the agency considers to be a serious and dangerous design flaw.
The company that manufactured the device, Baby Matters LLC of Berwyn, PA has apparently gone out of business and the owner, Leslie Gudel has issued a formal statement which says, “no infant using Nap Nanny properly has ever suffered an injury requiring medical attention”.
The CPSC had been in discussions with the company that would allow for some type of limited recall, but after talks broke down, the agency moved forward with its lawsuit to require a recall.
